US Supreme Court Transgender Service Ruling

FOR IMMEDIATE RELEASE

American Veterans for Equal Rights (AVER)

Today’s ruling by the United States Supreme Court to allow President Trump’s ban on Transgender service members to go into immediate effect will be a terrible blow to national security. The move by SCOTUS will terminate the service of pilots, weapons engineers, doctors, drill instructors, special forces and other highly trained and dedicated member of our armed forces for no other reason than ignorance and discrimination. While lower courts have issued stays against the ban, finding it likely unconstitutional, today’s ruling allows the ban to go into effect even as the other cases proceed.

“Transgender volunteers have been serving openly for over a decade” said AVER President Penn Baker, herself a Transgender US Navy veteran, “and their service alone is proof that that Transgender personnel are a tremendous asset to military readiness. Throughout our military’s long history the civilian court system has often deferred to military justice, allowing statements such as ‘X is incompatible with military service’ to bar women, racial minorities, and gay people from opportunities to serve. We thought we had moved beyond such discrimination, and we are confidant that the pending cases will overturn yet another unjust policy.”

AVER, which has been fighting LGBTQ+ bans for over 35 years, stands in solidarity with our fellow veterans and active duty service organizations in opposing policies that deny opportunity and remove vital skills from the military. The American people are less safe as a result of this action.

Active Duty Transgender Service

I think we all expected this.  For some reason I had not expected the DOD to have taken such a slash and burn approach to Transgender service.  As announced last night the DOD has taken the position to muster out all Active-Duty Transgender Service members.

“This is a purge of unprecedented magnitude. There is nothing confusing or complicated about it. The military has 30 days to identify anyone it thinks is transgender, and the only way to avoid discharge is to prove you are not transgender. This is an unconscionable ban that forces the removal of talented service members who put their lives on the line for our nation and slams the door on qualified patriots who meet every standard and want nothing more than to serve their country.”

—Jennifer Levi, Senior Director of Transgender & Queer Rights

I expect there will be legal maneuvering which could result in delays.  There are around 15,000 Active-Duty Transgender Service members in the crosshairs of this action.  How do we maintain National Security when we cart blanch remove those highly skilled service members?  In whatever way we can we must support them.  We can’t stand down now.  The next hit could be all LGBTQ+ people, our marriages, diversity in work force, and our standing in society are in jeopardy.

San Antonio, TX “Military City USA” (JAN 29, 2025)

President Donald Trump’s ban on Transgender military service members jeopardizes national security by removing thousands of highly skilled personnel from the critical job of safeguarding our nation from attack.

“The soldier who is wounded on the battlefield does not care if the medic who saves his life is Transgender,” said AVER National President Penn Baker, who is herself a Transgender veteran of the United States Navy. “AVER has been fighting for LGBT service for 35 years,” she said. “We’ve lost battles and we’ve won battles. This is a battle we’re not going to lose.”

American Veterans for Equal Rights is the nation’s oldest Lesbian, Gay, Bisexual, and Transgender Veterans Service Organization in the United States, founded to promote LGBT service equality in 1990.
